Welcome to Surfe API (“API”). By accessing or using our API, you (“User” or “You”) agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the API.
1. Definitions
1.1 API: The application programming interface provided by Surfe to enable Users to access people and company enrichment data.
1.2 User: Any individual or entity accessing or using the API.
1.3 Data: Any information or output provided by the API, including but not limited to people and company profiles, enrichment details, and metadata.
1.4 Authorized Use: The permitted and lawful use of the API as defined in Section 4.
2. License Grant
2.1 License: Subject to these Terms, Surfe grants You a limited, non-exclusive, non-transferable, non-assignable, revocable license to access and use the API solely for purposes in compliance with these Terms.
2.2 Restrictions: You may not:
- Reverse engineer, decompile, or disassemble the API.
- Use the API for any unlawful or unauthorized purpose.
- Redistribute, sell, or sublicense the API or Data to third parties without prior written consent.
3. User Obligations
3.1 Account Registration: You must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your API key.
3.2 Compliance: You must comply with all applicable laws, regulations, and these Terms when using the API.
3.3 Limited Uses: Unless otherwise agreed with Surfe, Surfe may set and enforce limits on the use of the APIs in Surfe’s sole discretion and may change the limits from time to time. You shall not attempt to exceed or circumvent limitations on access, calls, or other uses of the API, and shall not otherwise use the API in a manner that is excessive, abusive, or otherwise fails to comply with the API documentation, these Terms or any Surfe Agreement.
3.3 Prohibited Uses: You may not:
- Use the API to create or assist in creating competitive products or services.
- Access the API in a manner that exceeds reasonable request volumes or burdens system resources.
- Transmit any malware that may damage any system or data.
- Reverse-engineer or attempt to extract the source code from the APIs
4. Data Use and Privacy
4.1 Ownership: All Data provided by the API remains the property of Surfe or its licensors. You are granted a license to use the Data in accordance with these Terms.
4.2 Data Protection: You must handle Data in compliance with all applicable privacy and data protection laws, including but not limited to GDPR and CCPA.
5. Fees and Payment
5.1 Fees: Access to the API may be subject to fees as outlined in your agreement or subscription plan. Fees are non-refundable unless otherwise specified.
5.2 Changes to Fees: Surfe reserves the right to modify fees with prior written notice.
6. Termination and Suspension
6.1 Termination by You: You may terminate your use of the API at any time by discontinuing access.
6.2 Termination by Surfe: We may terminate or suspend your access to the API immediately if:
- You violate these Terms.
- Your use of the API poses a security risk or legal liability.
6.3 Effect of Termination: Upon termination, your access to the API and Data will cease, and you must delete any stored Data.
7. Intellectual Property
7.1 Ownership: Surfe retains all rights, title, and interest in and to the API, Data, and related intellectual property.
7.2 Trademarks: You may not use Surfe’s trademarks without prior written consent.
8. Disclaimer of Warranties
The API is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Surfe will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the API.
10. Indemnification
You agree to indemnify and hold harmless Surfe from any claims, damages, liabilities, and expenses arising out of or related to your use of the API or breach of these Terms.
11. Modifications to Terms
Surfe reserves the right to modify these Terms at any time. Your continued use of the API constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of France.
By using the API, You acknowledge that You have read, understood, and agree to be bound by these Terms and Conditions.
